These Terms of Service govern your use of CommercialKitchenFire.com and all related services. By accessing the site or submitting a quote request, you agree to these terms. If you do not agree, do not use the site.

1. Directory Disclaimer

CommercialKitchenFire.com is an online directory and lead generation platform. We do not perform fire suppression inspections, installations, hood cleaning, recharges, or any other fire safety services. All services are performed exclusively by independent third-party contractors listed in our directory.

We do not employ, supervise, or control any contractor listed on this platform. Each contractor is an independent business operating under their own licenses, insurance, and terms.

2. Contractor Verification Limitations

We make reasonable efforts to list contractors who hold relevant manufacturer certifications (ANSUL, Amerex, Pyro-Chem, Kidde) and maintain active NICET or equivalent credentials. However:

• Certifications change. Listings may not reflect real-time credential status.
• We do not verify state contractor licenses, local fire marshal registrations, or general liability insurance on an ongoing basis.
• It is the sole responsibility of the customer to verify that any contractor they hire holds valid licenses and insurance for their jurisdiction before work begins.

Listing on CommercialKitchenFire.com is not an endorsement, guarantee, or warranty of any contractor's work quality, compliance, or suitability for your specific job.

3. Lead Submission

When you submit a quote request, you authorize us to transmit your contact information and project details to the independent contractor associated with that listing. You represent that the information you provide is accurate and that you are authorized to engage a contractor for the described work.

Submitting a quote request does not create a contract with CommercialKitchenFire.com or with any contractor. A binding agreement exists only between you and the contractor, and only when both parties have agreed in writing to the scope, price, and terms of work.

4. Contractor Listings

Contractors who apply to be listed agree that the information they provide (company name, credentials, service areas, contact details) is accurate and current. Contractors are solely responsible for maintaining accurate listing information and for complying with all applicable laws, codes, and licensing requirements in their jurisdiction.

We reserve the right to remove or suspend any listing at our sole discretion for any reason, including but not limited to: inaccurate information, consumer complaints, lapsed credentials, or failure to pay applicable listing fees.

5. Paid Listings and Subscriptions

Pro and Enterprise subscription plans are billed monthly through Stripe. Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time through your account dashboard; cancellation takes effect at the end of the current billing period. Fees paid for the current billing period are non-refundable except as required by law.

Placement benefits (featured listing, priority in search results) are active only while a paid subscription is current. Downgrading or cancelling a subscription immediately removes paid placement benefits.

6. Intellectual Property

All content on CommercialKitchenFire.com — including programmatically generated city guides, compliance resources, and SEO copy — is owned by or licensed to us. You may not scrape, reproduce, or redistribute content without written permission.

Contractor names, logos, and trademarks displayed in listings remain the property of their respective owners. We display them solely to identify the listed business.

7. Prohibited Uses

You agree not to:

• Submit false, misleading, or fraudulent quote requests
• Use automated tools to scrape contractor contact information
• Attempt to circumvent rate limiting or security controls
• Impersonate another business or person
• Use the platform for any unlawful purpose

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CONTRACTOR LISTING IS ACCURATE OR CURRENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMMERCIALKITCHENFIRE.COM AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR FROM ANY SERVICES PROVIDED BY CONTRACTORS FOUND THROUGH THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED $100 USD.

10. Indemnification

You agree to indemnify and hold harmless CommercialKitchenFire.com and its operators from any claims, losses, or damages (including reasonable legal fees) arising from your use of the site, your violation of these terms, or any dispute between you and a contractor.

11. Governing Law

These terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Travis County, Texas.

12. Changes to These Terms

We reserve the right to modify these terms at any time. We will post the updated terms on this page with a new effective date. Continued use of the site after changes are posted constitutes acceptance of the revised terms.
